In Ukraine, the size of the pension payment cannot be lower than the subsistence level. This decision was made by the Constitutional Court of Ukraine (CCU), the institution reported.
It is noted that the court came to this conclusion after considering the constitutional complaint of one of the pensioners.
“The Constitutional Court of Ukraine defended the guarantee of a pension, which is the main source of livelihood, in an amount not lower than the subsistence minimum”- the message says.
As stated in the court decision, “the person was deprived of minimum social benefits and protection from poverty due to the enforcement of the decision.”
Thus, the court declared unconstitutional the prescriptions of paragraphs 4, 5 of part 2 of Art. 70 of the law “On Enforcement Proceedings”, paragraphs three, four of the second part of Art. 50 of the Law “On Compulsory State Pension Insurance” in that they make it impossible to pay - in the amount not lower than the subsistence minimum pension, which is the main source of subsistence, assigned in the amount of the subsistence minimum established by law.
The norms of the legislation providing for the possibility of deducting up to 50% of the pension as a recovery from the debtor are illegal.
It was about the norms of the legislation, which allowed to collect from pensioners up to half of the pension for various debts.
Recall that one-time assistance, which was paid in Ukraine to war veterans and victims of Nazi persecution annually on the eve of May 9, will now be paid by the Independence Day of Ukraine. This decision was made by the Verkhovna Rada.
