Subpoenas can be served by housing offices and condominiums: the lawyer explained when this is possible

Due to a shortage of employees, military registration and enlistment offices may also involve employees of the housing office and condominiums in the process of serving subpoenas.

The lawyer spoke about this Polina Marchenko.

“Representatives of condominiums and housing authorities have the right to serve subpoenas. TCC sends an order for service. And they go to apartments with ready-made summonses. That is, they didn’t write them out, they brought them,” – the lawyer explained.

But it is important that the summons be targeted, that is, assigned to a specific person indicating the name and surname of the person liable for military service. In addition, it must have the signature of a TCC representative.

After handing over the summons to the utility workers, the person liable for military service signs the document. Thus, he confirms receipt of it. In case of refusal to accept the document, the housing office employee must draw up a report about this with witnesses. If the utility worker simply placed the summons in the mailbox, then the document can be ignored.

Polina Marchenko also said that if a citizen received a summons and did not appear at the TCC, he must pay an administrative fine of just under 2 thousand UAH.

In addition, for repeated failure to appear, you can be punished with correctional labor for up to two years. Such punishment is provided for in Article 337 of the Criminal Code of Ukraine “Evasion of military registration or training (special) meeting.”
