“Society requires significant changes”: Andrey Smirnov on the accessibility and quality of justice in Ukraine

Without the introduction of judicial reform, without strong and respectable institutions in the judiciary, without restoring confidence in it, there is no talk of investing in Ukraine precisely because of the lack of mechanisms for fair protection of these investments. This was stated in an interview with the editor-in-chief of LB Sonya Koshkina Deputy Head of the Office of the President Andrey Smirnov, which deals with the main field of legal issues and is one of the main drivers of the profile reform.

“The meeting with the G7 was the first working meeting in this format, and it was the first precisely because judicial reform continues to be a priority for Ukraine’s key international partners. Actually, without putting this reform in order, without strong and respectable institutions in the judiciary, without restoring confidence in it, we are not talking about investments precisely because of the lack of mechanisms for the fair protection of these investments in the courts,” Andrey Smirnov said.

According to him, the historical period in which the country is located requires significant changes, and the judiciary must wake up and finally understand that it will no longer exist in the realities in which it existed and worked before the full-scale invasion.

“Many people will return home after the victory of Ukraine, many soldiers. And trust that their expectations of the availability of justice, the quality of justice and fair decisions will be as high as possible. And I am very worried that the methods of solving or achieving this justice will be very different from those in 2014, when there were so-called garbage lustrations.”he says.

Smirnov called the last 30 years a simulation of change and the reformatting of the judiciary for each individual political command.

“The key problem of all stages of judicial reform during these years was that we must seek a compromise with the judiciary. Very often, the seating position determines the point of view. This is me about the functionaries of the judiciary. They have always appealed to the fact that their voice should be decisive in determining the vector of judicial reform, and, to tell you frankly, this has always been a big hindrance. And now is a historic moment when it is necessary to look for a compromise, but also carefully look to see if behind this compromise there is an attempt to drag out the reform, to preserve the good old rules of the game in the industry. These rules need to be changed, to take the best world practices, optimize institutions, go to the highest standards.”he says.

Smirnov believes that individual functionaries have concentrated the levers of influence on judicial reform in the hands of individuals. I cIt is definitely not about reform and not about the development of independent institutions, the official says.

“We are determined to take the most cardinal and decisive steps. We want the rule of law to reign in the country. We want this country to finally have legal certainty. We want this country to have a Supreme Court as a court of law. We want the maximum adaptation of Ukrainian legislation to EU standards.”- said the deputy head of the OP.
