During martial law and mobilization, those liable for military service must notify the territorial recruitment and social support centers (former military registration and enlistment offices) of a change in place of residence. But now there are many migrants in the country, who as a result are forced to change their place of residence.
Why do male migrants need to be registered with the military after moving to a new place and what threatens if this is not done, Ekaterina Anishchenko, lawyer at Riyako & Partners law firm, said in a commentary for RBC-Ukraine.
According to her, immediately after the move, the migrant must be registered with the military registration and enlistment office at his physical place of residence.
“In order not to violate the procedure and then not pay an administrative fine, it should be done in exactly this sequence: first the military registration and enlistment office, then the social protection center. In general, you can first apply for an IDP certificate, but if you are stopped on the street to serve a summons, then the question arises why you did not inform the military registration and enlistment office about your new place of residence.”the expert explains.
She notes that in such a situation a fine of 1,600 to 3,500 hryvnias is imposed. It should be taken into account that the amount of the fine in a particular case is established by the military commissar and can interpret this rule at its discretion.
But it is not necessary to say that military registration and enlistment offices now have access to the register of forced migrants, the register of acts of civil status. TCC employees now learn such data, mainly when they write separate requests to the relevant structures, the lawyer says.
If, after serving the summons, it turns out that the IDP did not inform the TCC about the change of residence, he faces a fine.
“Now they often say that these powers of the military registration and enlistment offices will be expanded. But at present, the military registration and enlistment office can make a separate request to the center for the provision of administrative services in relation to a specific person, whether he is registered. But to say that they do it consistently once a week, especially in order to register new people, is definitely not, there is no such thing.- notes Anishchenko.
On the other hand, she knows cases when people came to a certain area as internally displaced persons, and neighbors or someone else informed the military registration and enlistment office that IDPs had settled there.
“If a man of military age does not immediately go to the military registration and enlistment office, but only applies to the TsNAP for an IDP certificate, he will not be refused, everything will be processed. But if he lives in another area and received a summons, then first of all he will receive a fine in the military registration and enlistment office, ” the lawyer says.
