Getting a deferment from mobilization is real: who can use this right

In the case of caring for an elderly person or a person with a disability, men can receive a deferment from mobilization into the ranks of the Armed Forces of Ukraine.

“The guardians of a person with a disability recognized by the court as incompetent have the right to such a delay,” - the message says.

Such a right is also granted to persons caring for a person who, according to the conclusion of the MSEK or a medical commission, needs constant care and does not have other relatives who can care for (Article 23 of the Law of Ukraine “On mobilization training and mobilization”).

At the same time, it is noted that care can be provided only for members of one’s own family who live together, are connected by a common life, and have mutual rights and obligations.

Lawyers also remind that it is possible to arrange care for elderly citizens with cognitive impairments. To do this, it is obligatory to obtain the opinion of the medical commission of the medical institution on the need for care (Part 6 of Article 13 of the Law of Ukraine “On Social Services”).

A special case - if the parents, wife or parents of the wife have a disability of I or II group. In this case, the man has the right to a deferment without registration of care or guardianship (Article 23 of the Law of Ukraine on mobilization training and mobilization).
