Recently, the exploitation of military-patriotic themes for commercial purposes has caused indignation in society. This creates fierce battles on social media. Therefore, it was decided at the legislative level to prevent such commercial use of the events during which people died, as well as to exclude the use of other sensitive names, images and signs associated with resistance to Russian military aggression. “A few words about the situation with the registration of trademarks or the placement of commercial advertising, which uses the themes of the Armed Forces of Ukraine, the defense of the country and other iconic symbols related to the repulse of Russian aggression. In reality, there is no limit to indignation when you read about the proposal of hair removal against the backdrop of our military and under the slogans of helping the Armed Forces of Ukraine, or you meet various drinks, including alcoholic ones, in the name of which the names of Ukrainian cities are used, the history of which is full of not only heroism, but also tragedy“, Smirnov emphasized.
According to him, advertising should not contain information or images that violate ethical, humanistic, moral standards, neglecting the rules of decency.
“Legislation prohibits the placement of advertisements that may cause harm to individuals, the state or society. Also, legal protection of a trademark is provided if this trademark does not contradict public policy or generally recognized principles of morality.‘, the official explained.
So, on March 27, a working meeting was held with two state regulators - the State Food and Consumer Service and the Ukrainian National Office of Intellectual Property and Innovation. During this meeting, the participants agreed on the immediate launch of “hot lines” in both structures, including territorial bodies for prompt response to such cases.
“At the same time, we launched the process of preparing legislative changes that would make the process of the state’s preventive response to such cases of dysfunctional activities that violate the norms of public morality quick and understandable, and the responsibility for violation more tangible“, Andrey Smirnov added.
