Will the government “force” hospitals to treat patients better? Adam Niedzielski announces changes to the healthcare system

The best will be rewarded, and the patients themselves will be the judge. Today Health Minister Adam Niedzielski presented planned changes to improve the quality of care in Poland.

The press conference organized on 9 May 2023 by Minister Adam Nedzielski dealt with new draft laws on the quality of patient care. In addition to the Minister of Health, MPs Józef Szczurek-Zielazko and Czesław Hock, Chairman of the Board of Patients’ Organization Father Arkadiusz Nowak and Ombudsman for Patients’ Rights Bartłomiej Chmiełowiec also took part in the press conference.

The patient will evaluate the healthcare system

The government wants to introduce three new legislative decisions in the field of quality of care. They must guarantee higher standards of medical care to patients. One of the most important changes proposed by the Ministry of Health is the law on the quality and safety of patient treatment.

“We will measure this quality in the healthcare system, and it will become the basis for rewarding those actors who are better. But in fact, the most important solution of this bill is that the patient will have the right to evaluate the health care system in various areas. […] The patient will be able to evaluate medical services […] first of all, from the point of view of whether they were carried out in conditions that ensured the dignity of the patient, gave him the opportunity to understand the situation of the disease that struck him,” Adam Nedzielski emphasized.

Quality assessment will take place at three levels: clinical (taking into account the treatment process and effect), consumer (patient satisfaction) and managerial.

Patients will get the compensation they deserve faster

The second solution, along the lines of those used in the Scandinavian countries, is to create - by amending the Patient Ombudsman Act - a Medical Compensation Fund. The procedure for obtaining compensation will be simplified. Applications of patients are considered within 2-3 months. Relatives of a person who died as a result of this medical event will also be able to apply for compensation. The fund will replace the commissions operating in the voivodship offices.

Not guilty clause in a separate act

The third decision concerns the no-fault clause. It will not be included in the proposed projects. The Minister of Health has appointed a panel to address the issue of exemption from criminal liability for medical malpractice. It will include experts and representatives of various environments interested in the creation of the aforementioned system. The conclusions of the discussions will be included in a separate act.
