Employees who have not yet gone on vacation in 2021 must do so by the end of September. The employer is responsible for ensuring that the employee goes on overdue leave on this date.
The question arises, can an employer force an employee to go on vacation? The answer is yes.
- As part of the anti-crisis shield related to the COVID-19 pandemic, a provision has been introduced that an employer can send an employee on leave outside the established period of up to 30 days during an epidemic or epidemic emergency without his consent and without accepting vacation plans. The state of the epidemic threat is still in force, and with it the whole recipe, explains Mateusz Boguszewski, chief accountant of inFakt.
It should also be remembered that the employee must use the remaining leave in kind, it is impossible to pay the equivalent or agree on this with the employer. The term of September 30 is final, however, in order to fulfill the obligation, it is enough for the employee to start the vacation on this day and continue it in October.
Employers who do not fulfill their obligations and do not provide the employee with the remaining vacation will face fines. - It can be a fine from 1,000 to 30,000 PLN. The only circumstance that excludes the liability of the employer is accidental events, such as, for example, the illness of an employee - notes Mateusz Bogushevsky.
