When retiring by age, every Ukrainian hopes to receive decent payments, but sometimes hopes do not coincide with the first payments.
However, there is a small trick that will help increase pension payments. It was advised to pensioners by an independent expert Sergey Korobkin on the pages of the Social Platform.
Although only those born at the beginning or end of the year can use this technique.
A reader from Dnipro contacted the editorial office of the publication. Tatyana Leonidovna proposed to raise the topic of electronic assignment of pensions. On January 11, she turned 60 years old, but she submitted an application for a pension in December, by sending it remotely through the Pension Fund’s electronic services web portal. This played a cruel joke on the woman. As a result of such actions, according to her, the pension was assigned ahead of schedule and the old, that is, less profitable average wage in the country, was taken into account for the calculation.
“Let’s note right away that the point is not how the documents were submitted: remotely or in person. Here we are talking about the deadlines for submitting documents and the corresponding legislative subtleties, ” – writes the expert.
An old-age pension is assigned from the day following the day of reaching the retirement age, if the application for the appointment occurred no later than three months from the date of reaching such an age. At the same time, the day of applying for the appointment of a pension is the day when the body assigning the pension accepts the relevant application. If an application for the appointment of a pension is submitted through the Pension Fund services portal, then the day of applying for the appointment of a pension is the date of registration on the application web portal along with scanned copies of documents that correspond to the original documents and are suitable for the perception of their content (must contain a clear image of the full text of the document and his details).
An application for the appointment of a pension can be made at any time after the right to a pension arises or not earlier than one month before reaching the retirement age.
Therefore, in this case, as provided by law, the pension was appointed from January 12, that is, upon reaching retirement age. Although the application for the appointment of a pension was submitted a little earlier. This is also permitted, but rarely practiced.
Why is part of the pension lost?
Recall that for the appointment of an old-age pension, the average salary in Ukraine for three calendar years preceding the year of applying for a pension is applied. Here it is important to pay attention to the exact wording in the law. This is not about the year of the appointment of a pension, but about the year of applying for its appointment.
In this case, as already noted, the pension was assigned upon reaching retirement age, that is, already from January 2023. However, the direct application for the appointment of a pension took place in December 2022. Thus, to calculate the pension, the average salary for 2019-2021 was taken into account, that is, for the three years preceding the year of applying for its appointment. If the application for a pension was submitted in 2023, then the newer and higher average salary for 2020-2022 would have been taken into account for its calculation.
Tatyana Leonidovna tried to arrange everything in advance, but she certainly did not know these nuances. Therefore, the size of her pension will now indeed be lower than expected.
In this case, the Pension Fund acted clearly within the limits of the law, and it is difficult to appeal such a decision even in court.
“Perhaps, if a person applied to the Pension Fund personally, the specialist could advise not to rush to submit an application, but to postpone it until January in order to apply for a pension on more favorable terms. However, here the appeal was received through the web portal of electronic services, so the assignment of the pension took place automatically,” – writes the expert.
In other words, in such an important matter as the appointment of a pension, there is no need to rush, especially those born in November-December or in the first months of the year. And remember that by submitting an application later, the amount of the pension can be increased.
