Mobilization is underway in Ukraine, in connection with which men under 60 can receive summons. Some categories of citizens have the right to serve at their place of residence. This applies, for example, to persons with disabilities, parents of large families or parents of children with disabilities and seriously ill children.

There are cases when a conscript is handed a summons when he is in another region. How to proceed in such a case, explains lawyer Irina Leonova on the site b2bconsult.ua, answering the questions of a man living in an area that was merged with another. “The local recruitment center became a department of the recruitment center in Mukachevo. If I am handed a summons when I am on business in the city, demanding to come to a recruiting center to which I am not assigned, then what should I do? Would this agenda be legal? - he asked.

According to her, the functions and tasks of the Territorial recruitment and social support centers (TCC and SP) remained the same. Even after the renaming of the TCC, conscripts and those liable for military service remain on the military register according to their territorial affiliation.

“So, you should not serve a summons from the TCC, to which you are not assigned. It is illegal to hand over the summons at the place of residence, since the registration of persons liable for military service is carried out at the place of registration. If this happens, then you should explain why you are in a particular place, inform that you are registered in another locality “she noted.

If the summons is served anyway, then the lawyer advises to insist on drawing up an act of refusal to receive it. It should be borne in mind that representatives of the TCC do not have the right to send for any actions to recruitment centers in another region, but they can send social support to the territorial recruitment center to clarify military credentials at the location on the register, if events occur on one territorial unit, that is, in one area

A man has the right to refuse to receive a summons within the framework of the law if:

  • the name of the person is incorrectly indicated on the form - there is reason to believe that this summons is addressed to another person;

  • the summons is served by an unauthorized person;

  • the document does not bear the stamp of the TCCSP/signature of the military commissar;

  • old agenda template.

“If you refuse the agenda, you need to voice the reasons, and authorized persons must draw up an act of refusal”she added.

Previously, lawyers explained how to act for a person liable for military service who has illnesses, but does not have supporting documents.
