The Netherlands is ready to host on its territory a new tribunal with the support of the UN to consider Russia’s aggression against Ukraine, said Dutch Foreign Minister Wopke Hoekstraquoted by Reuters

According to him, the competence of the new tribunal will not interfere with the activities of the International Criminal Court, also based in the Netherlands. He added that the Netherlands, with the support of the European Union, will seek international support and funding for this court.

European Commission President Ursula von der Leyen said in November that a new tribunal with broad international support would be needed to ensure that the Russian invasion was described as “act of aggression“, will not go unpunished, recalls Reuters.

An act of aggression is defined by the UN asinvasion or attack by the armed forces of a state on the territory of another state or any military occupation“. Experts note that the jurisdiction of the ISS on aggression extends only to states that have accepted the Rome Charter establishing a court, and states that have agreed to its jurisdiction. Ukraine has signed the act of membership in the ISS, but has not ratified it, while Russia is not a member of the court and has not agreed to its jurisdiction.

The Netherlands is also home to the International Court of Justice and the ad hoc tribunals for Lebanon and Kosovo. For many years, it also housed a war crimes tribunal for the former Yugoslavia.
