The state cancels the obligation to pay salaries to mobilized workers

Mobilized workers will no longer be paid the average wage. Such changes are provided for by the Law on Amendments to Certain Laws of Ukraine on the Optimization of Labor Relations, signed by President Volodymyr Zelensky.

“If you are an employer who has mobilized workers, you need to prepare orders to stop paying them average wages (as soon as the law takes effect after publication), explains Yulia Ryabets, Senior Litigation Associate. — If you are a mobilized worker, you are responsible for the payment of monetary allowance at the expense of the State Budget of Ukraine in accordance with the Law of Ukraine “On the social and legal protection of military personnel and members of their families.” The sizes are established by the Cabinet of Ministers, taking into account the nature and conditions of service. We are talking, in particular, about UAH 30,000 and UAH 100,000 for military personnel at the front.

The position of the authors is that it is unfair to force employers during the war to pay average wages to workers who actually do not perform their work. After all, business is now going through hard times: mass evacuation of employees, logistical difficulties, a decrease in sales, respectively, a decrease in income.

The number of people mobilized since the start of the war in the Donbas in 2014 and the start of a full-scale Russian invasion are completely different indicators, different periods of absence of such workers in the field. For its part, the financing of such military by the state during a full-scale war was increased and not canceled. These payments are formed according to the payment of taxes, in particular by the same employers”

The lawyer notes that the employer still has the right to keep the average salary and this will not be a violation of the law.
