Rafako and Tauron finally came to an agreement. The final terms of the settlement agreement are to be signed on February 28. The conflict between the companies has been going on for several months. The dispute concerns the coal block of the Yaworzhne power plant.
“Indication of the directions and issues of further negotiations that the Contractor and Tauron Wytwarzanie intend to agree on as part of mediation in the Arbitration Court, including the obligation to negotiate and mediate to agree on the final terms of the settlement agreement by February 28, 2023 and sign the settlement agreement by March 8 2023, - we read in Rafaco’s communiqué.
Dispute over Jaworzno power plant
The conflict between the companies, which has been going on for several months, has recently escalated. In January, the companies met during mediation at the Prosecutor’s Office of the State Treasury. However, the negotiations did not bring any results, since, according to representatives of Tauron, they were thwarted by Rafaco.
“We look forward to serious negotiations aimed at a peaceful solution of disputed issues. A condition for their success is Rafako’s rejection of the idea of unfounded claims, extending the warranty and presenting a realistic timetable for fixing identified defects and malfunctions, said Traian Shuladzinski, president of Tauron Wytwarzanie.
Blocking in Jaworzno does not work. Companies shift responsibility
Tauron called on Rafaco to pay contractual fines and compensation worth more than PLN 1.3 billion. The company claims that the new block of the Jaworzno power plant, built by Rafako, has hidden defects that have not yet been fixed by the contractor.
“Rafako has not fixed more than 100 reported defects, of which more than 30 have not been fixed for more than two years. Rafako also refuses to acknowledge obvious design defects,” the company said in a press release.
- The identified physical defects that Rafako received from us on a long list have not been eliminated. The company also did not provide us with a realistic plan to address them or a viable concept for completing the transition period. Most importantly, we also did not receive confirmation that the installation complies with the technical parameters of the contract, President Shuladzinsky said.
