You hit a pothole and damaged a tire, your car was damaged in a collision with a wild animal, you skidded on an icy road - all these events should be reported to the road manager. Tell us who he is and what he is responsible for.
A road manager is a person or institution that oversees its operation. The definition of a traffic administrator is specified in Art. 19. Law of March 21, 1985 on public roads, which defines a road manager as: “a state administration body or a local self-government unit in charge of planning, construction, reconstruction, repair, maintenance and protection of the road”.
What is the road manager responsible for?
The road manager is responsible not only for the construction of new routes, but above all for the maintenance of existing roads and all road infrastructure such as sidewalks, traffic lights, engineering structures and traffic safety devices (including bollards, shelters, traffic dividers, road barriers). ). He is responsible for the technical condition of the road, its maintenance and possible reconstruction and expansion. Drivers can claim compensation from the administrator of a given road for damage caused to the vehicle, such as damaged pavement. But not only.
The road administrator is also responsible for protecting drivers from wild animals. It should include guardrails on highways or special viaducts or tunnels to help animals cross safely to the other side. If the use of this type of protection is not possible, he must put up a road warning sign (A-18b - “Attention, wild animals”).
In winter, the road manager is responsible for clearing snow and ice. So if we skid on an icy road and damage the car, we can claim compensation with it. Also, if the chassis of the car is damaged as a result of hitting a speed bump, we can demand compensation from the traffic administrator. However, in the last two cases mentioned, it is not necessary to obtain it. The reason for the failure may even be too high a vehicle speed. Compensation may be awarded provided that we can prove negligence by the road operator.
