“All states are in favor of its creation”: Smirnov on the mechanism of work of the Special Tribunal on Russian Crimes in Ukraine

Last week in Strasbourg, the Second Meeting of the Core Group (Coalition) on the establishment of a Special Tribunal for the Crime of Aggression against Ukraine took place. It was attended by representatives of 33 member states of the Core Group, as well as representatives of the European External Action Service, the European Commission and the Council of Europe. This was announced by the deputy head of the OP Andrey Smirnov. According to him, a lot of interesting things are temporarily left behind the door, but he spoke about some key points.

“The issue of establishing a Special Tribunal remains on the agenda of the international community, and international partners do not deny the advisability of creating a Special Tribunal. All states are in favor of its creation, only the model that will create the proper legitimacy of its work has questions, ” Andrey Smirnov emphasized.

He added that Ukraine presented the issue of establishing and launching the International Center for the Prosecution of the Crime of Aggression against Ukraine (ICPA), and also provided information on how interested states and international organizations can join. for the operation of the Centre.

“The issue of involving the countries of the Global South (countries of Latin America, Africa, Asia and Oceania) in the work of the Core Group was discussed. Individual current members of the Coordinating Group began advocating for the inclusion of individual countries in these regions into the group. The main goal of the work of the Core Group should be to develop broad political support for the model of creating a tribunal and its “internationality”, - continued the deputy head of the OP.

He noted that discussions continue on the issue of different models for establishing and operating the Special Tribunal and ensuring the implementation of its decisions, the issue of immunities for the leaders of the aggressor country.

Smirnov also noted that the warrants issued by the International Criminal Court within the framework of the functional mandate of the ISS in no way reduce the urgency of the issue of creating a mechanism for punishing the crime of Russian aggression against Ukraine.

The next meeting in a similar format will be held in May.
