How to cross the border and how much money to take so as not to be taken away: lawyers dispelled myths about leaving Ukraine

After the introduction of martial law, the procedure for crossing the state border has become one of the main topics in the information space. And around him there are many manipulative moments. Where is the truth and where is the myth, experts of the Legal Adviser for IDPs explained.

one. When asked whether it is true that only citizens of Ukraine can be held accountable, the lawyers answered as follows: “No. In fact, both citizens of Ukraine and foreigners and stateless persons can be punished if they:

  • violate or attempt to violate the border or established regime at checkpoints across the state border;
  • facilitate illegal border crossing by other persons;
  • illegally move goods, materials, documents and other items across the state border.

2. Another common question is when liability arises: only if it is illegal to cross the border in a car? Experts answer it like this: “Not really. Violation or attempted violation of the border regime or regime at checkpoints across the state border may occur when leaving the country in any way, including: on foot, by car, by rail, water, horse-drawn and any other transport. Also, liability arises if a person crossed the border on the basis of a fake document or outside the checkpoint at all (for example, when the checkpoint was not working, outside the established pedestrian and transport corridors, in places not designated for crossing the border)”.

3. Many do not understand whether any export of cash abroad is considered a violation? The lawyers explained: “Responsibility arises only in case of non-declaration of funds in excess of the established limit.

For one person, including a baby, it is allowed to transfer cash hryvnia, foreign currency and bank metals for a total amount of 10,000 euros in equivalent without declaring.

four. If there are more funds or banking metals, then experts advise doing the following: “They must be declared in writing during customs control with the provision of documents confirming the legality of their origin, namely:

  • withdrawal of cash from own accounts in banks (financial institutions);
  • carrying out a currency exchange transaction with cash, if any;
  • purchase of banking metals.

In the absence of a declaration, a fine of 20% of the amount exceeding 10,000 euros will have to be paid. So, in case of discovery of undeclared 15,000 euros, the violator will face a fine of 1,000 euros (in hryvnia equivalent).

5. In case of violation of the rules for crossing the state border, is it enough to pay a fine - this question is also of interest to many Ukrainians. The lawyers answer is: “It’s true, but in part. Depending on the situation, the violator may expect both administrative and criminal liability. So, in case of crossing the border outside the checkpoints, without the appropriate documents, permission from the authorities or on a false document, such types of punishment can be applied as:

  • fine - from UAH 3,400 to 13,600;
  • administrative arrest for up to 15 days, with confiscation of tools and means of committing an offense (for example, with confiscation of a car in which an attempt was made to cross the border).

Criminal liability will take place if the crossing of the state border of Ukraine was carried out: with the aim of causing harm to the interests of the state, which can certify, in particular, documents found in a person, campaign leaflets, weapons, etc.; persons who are prohibited from entering the territory of Ukraine, representatives of units of the armed forces or other law enforcement agencies of the aggressor state.
