Workers in special circumstances are entitled to leave to search for work. Applies only to persons who were hired under an employment contract (regardless of whether the contract was concluded for a definite or indefinite period) and received notice of dismissal from the employer. At this difficult moment, when the employee knows that he will soon be left without income, he can take advantage of the special privilege of searching for a new job during the notice period.

Who is entitled to job search leave?

Leave to look for work is the so-called leave to look for work. It is paid to an employee with whom the employer has terminated the employment contract. With at least two weeks’ notice, each employee has the right to seek new employment while retaining the right to remuneration, subject to appropriate application. The amount of job search leave depends on the notice period.

How to get a day off to look for a job?

To take advantage of the available interview time, you must submit an application to your current employer. The application must indicate that we need a day off to look for a job to which we are entitled (Article 37 of the Labor Code). If the employment contract was terminated due to the fault of the employer, we have the right to take advantage of this privilege.

When are you not entitled to a day off to look for a job?

You are not entitled to job search leave in a situation where the employee has terminated the contract with the employer. If he leaves the company voluntarily because he is looking for other opportunities for development, wants to change his field of activity, or moves to another city, he cannot ask his boss to give him a day off to look for a new job.

How long is job search leave?

Job search leave is:

  • 2 working days – during the two-week and one-month notice period;

  • 3 working days – during the three-month notice period, including in case of its reduction in accordance with Art. 361 § 1.

What determines the notice period?

The notice period depends on the period of employment with the employer. Total:

  • 2 weeks – for an employment contract for a period of no more than 6 months

  • 1 month – with an employment contract for a period of at least 6 months

  • 3 months – with an employment contract for at least 3 years
